Subject of the Contract:
a. These “General Terms and Conditions” govern the terms relating to the use of the Service Provider’s accommodation and services.
b. The terms of these regulations do not cover separate individual agreements concluded by the Service Provider, e.g. with travel agencies, travel intermediaries or event organisers, whose individual provisions may differ from these terms.
Contracting Party
a. The services provided by the Service Provider are used by the Guest.
b. If the order for services is submitted directly by the Guest to the Service Provider, the Guest is the Contracting Party. The Service Provider and the Guest jointly — subject to the fulfilment of the terms — become contracting parties (hereinafter: the “Parties”).
c. If the order for services is submitted to the Service Provider by a third party on the Guest’s behalf (hereinafter: the “Intermediary”), the contract concluded between the Service Provider and the Intermediary governs the terms of cooperation. The Service Provider is not obliged to examine whether the Intermediary lawfully represents the Guest.
Contractual Relationship
a. In response to the Guest’s written request for a quote, the Service Provider sends an offer. Rooms are sold subject to available capacity, and the Service Provider confirms bookings in the order in which they are received.
b. The contract is formed when the Guest’s order — submitted in writing (by letter, email, or via an online platform) — is confirmed in writing by the Service Provider. In the case of an online booking, the contract is not considered a contract concluded in writing, and the Service Provider does not register it as such. The language of the contract is Hungarian. The Service Provider confirms the formation of the contract electronically.
c. The Guest may submit an online booking through the hotel’s website by selecting the “Booking” menu, then “Price Calculation & Online Booking”.
The online booking process is as follows:
Select the stay period by clicking the arrival and departure dates on the calendar.
Enter the number of adults and children per room (and the children’s ages). A maximum of 3 rooms may be booked within a single reservation.
From the list of available rooms and prices displayed, select the most suitable room by clicking “Select”.
On the next page, you can choose additional services for the booked room.
On the following page, a summary of the booking details is shown. If all the given parameters are correct, you must then provide: the booker’s title, surname and first name, company name (for a company booking), the booker’s address (postal code, city, street, house number, country of residence), phone number, and email address entered twice (the second as confirmation). The comment field allows you to provide any other information about the booking to the Service Provider.
Select a payment method. To initiate online payment, select either the debit/credit card or the SZÉP Card payment method.
Before clicking the “Finalise Booking” button, you must accept the terms set out in the GTC and the Privacy Policy.
Following a successful online booking, the Guest receives an immediate email confirmation. The online contract is not considered a contract concluded in writing and the Service Provider does not register it as such; however, the confirmation is sent by email.
d. The contract is concluded for a specific period and its content covers the subject, place, duration and price of the service, as well as the payment, cancellation and modification terms.
e. If the Guest permanently vacates the room before the end of the specified period, the Service Provider is entitled to the consideration for the service.
f. The Service Provider is entitled to re-sell a room that becomes vacant before the end of the booked period.
g. The Guest may initiate an extension of the accommodation service, which requires the Service Provider’s prior consent. In this case, the Service Provider may require payment for the service already provided.
h. Amendments to the contract are made in writing (including by email).

The Hotel’s Basic Services
a. Accommodation Service
The Service Provider offers hotel accommodation in various room types:
Standard Twin Room
Standard Triple Room
Superior Room with garden view
Suite
If a triple or family room is booked online for 2 people, the hotel reserves the right to provide the guests with a twin room without an extra bed.
Children up to 2 years of age can be accommodated in a crib or in bed with their parents. A crib can be requested free of charge after selecting the room type.
b. Catering
i. The hotel’s basic package does not include meals. However, buffet breakfast can be requested and consumed during the restaurant’s opening hours.
ii. Food or drinks may only be taken out of the restaurant with the prior permission of the restaurant manager.
iii. The hotel bar is a further catering outlet.
iv. Guests following a vegetarian diet can generally choose from the buffet offering; however, the hotel is not equipped to cater to guests following a vegan diet. The kitchen is not a gluten-free, lactose-free, or otherwise allergen-free environment, so the possibility of cross-contamination cannot be excluded. In accordance with food labelling regulations, the Service Provider provides written allergen information. Ingredients required for special diets are not always available, so guests requiring a special diet are advised to make arrangements in advance.
c. Conference Services
i. Event rooms and conference services can be used following prior arrangement.
Prices
a. The Service Provider’s dynamically set prices can be found on the hotel’s website under the “Price Calculation and Online Booking” menu.
b. Prices for the hotel lobby bar’s services are also available.
c. The Service Provider may freely change its published prices without prior notice; the price change applies to future bookings.
d. When publishing prices, the Service Provider indicates the legally regulated tax content (VAT) of the prices. Any additional burden arising from a change in the applicable tax legislation is passed on to the Contracting Party by the Service Provider, with prior notice.
e. Prices do not include the tourism tax (IFA) payable under law, which the Guest must pay on site.
f. The Service Provider advertises its current offers on the www.visvitalishotel.hu website for informational purposes, indicating prices starting “from”. Currently bookable prices, depending on available capacity, are available on the hotel’s website and can be booked under the “Booking” menu, in the “Price Calculation and Online Booking” submenu.
g. The Service Provider’s offers are available to Guests only for a limited room capacity.
h. The Service Provider does not publish prices for events, conferences, or group bookings in advance; these are sent to the client upon a specific request for a quote.
Child Discount
The child discount applies when a child shares a room with one or two adults, staying between the parents or in a crib. In this case, the discount is 100%.
Pets (Dogs, Cats)
a. The hotel does not accept pets.
Payment Terms
a. The Service Provider may require, in part or in full, an advance payment for the services provided to the Contracting Party before the service begins. The advance payment terms are included in the booking confirmation.
b. The advance payment can be made by bank transfer, or on site by card, cash, or SZÉP Card. Any costs arising in connection with the payment are borne by the Contracting Party.
c. Online booking is available to the Guest via the hotel’s website. In the case of an online booking, online payment is also possible, for which the debit/credit card payment method must be selected. After clicking the “Finalise Booking” button, the Service Provider redirects the Guest to the selected payment provider’s website, where payment can be made by card via an encrypted transaction, using the method currently considered most secure by the providers. Settlement of the booking amount is possible in the following ways: Online card payment: OTP SimplePay (accepted cards: Maestro, MasterCard, Visa, Visa Electron). Following a successful purchase, the payment provider issues an authorisation number for the transaction and notifies the booker by email of the transaction’s success. In the event of an unsuccessful transaction, the providers communicate the reason for the failure in an error message. In the event of a successful transaction, the Guest receives the booking confirmation by email.
d. If the booking is made on the day of arrival, the Guest pays for the ordered services upon arrival, before occupying the room.
e. Special individual payment terms apply in special cases, which are set out in the confirmation.
f. The Service Provider is entitled to request a guarantee from the Guest, before the service begins, during hotel check-in, for pre-ordered and on-site requested services. The guarantee may be given in cash or as a credit card guarantee.
g. The Service Provider requires payment for the services provided to the Contracting Party at the latest following their use, before departure from the hotel. Deferred payment is only possible under an individually concluded written agreement.
h. The Contracting Party may settle the invoice in cash, in forint or euro, as well as by card or SZÉP Card.
i. In the case of payment by SZÉP Card or bank card, the Service Provider may request the Guest to present an identity document to verify legitimate card use.
j. The invoice can also be settled by debit or credit card.
k. The invoice is issued in forint in accordance with Hungarian tax regulations. Prices quoted in foreign currency are converted to forint at the daily rolling exchange rate determined based on the National Bank of Hungary’s (MNB) exchange rate.
l. Contracts concluded with travel agencies, event organisers, or other contracted partners contain the individual payment terms.
m. The Service Provider may require a higher advance payment for certain periods; this is always specified in the payment terms of the confirmation.
Cancellation and Modification Terms
a. Ordered services may only be modified or cancelled in writing.
b. The date or number of guests of an ordered and confirmed booking may be modified, subject to available capacity, in writing, up to the last day of the penalty-free cancellation deadline.
c. Modification of the date beyond the penalty-free deadline is possible subject to payment of the applicable penalty.
d. Ordered services may be cancelled free of penalty until 24:00 on the 10th business day before arrival. In the event of cancellation after the penalty-free cancellation deadline, or in the event of non-arrival (“no show”), the value of the ordered services will be charged as a penalty, which may not exceed the total amount of the ordered service. Individual agreements concluded with a travel agency or event organiser for group bookings are subject to different cancellation terms, as set out in the individual agreement.
f. In the event of cancellation after the penalty-free cancellation deadline, the value of ordered but unused services is non-refundable, unless otherwise provided by law.
g. In the case of early departure, if the Guest permanently vacates the room before the end of the specified period, the Service Provider is entitled to the full consideration for the service stipulated in the Contract. The Service Provider is entitled to re-sell a room that becomes vacant before the end of the booked period.
Exclusion of the Right of Withdrawal
Under Section 29(1)(l) of Government Decree 45/2014 (II.26.), consumers are not entitled to the 14-day unconditional right of withdrawal in the case of accommodation services provided for a specific date or period.
Peak Periods
a. Year-end/New Year periods, periods of events held at the Hungaroring
Methods and Terms of Using the Service
a. The Guest may occupy the hotel room from 3:00 PM on the day of arrival and must vacate it by 10:00 AM on the day of departure.
b. Subject to hotel occupancy, early arrival or late departure is available upon prior arrangement. Luggage storage is available at reception.
i. Early arrival is possible from 10:00 AM; the hotel can confirm the request on the day before arrival (subject to occupancy). The early arrival fee is HUF 10,000/room/occasion.
ii. Late departure can be provided by the hotel at the earliest on the day before departure, if there is no arriving guest for the given room on that day.
iii. The late departure fee is HUF 10,000/room (2 people)/occasion. Includes: late check-out until 4:00 PM.
c. The amendment to Act CLVI of 2016 on the State Tasks Related to the Development of Tourist Regions, which entered into force on 1 January 2021, obliges the accommodation service provider to record the legally specified data of guests using the accommodation service in a data storage facility provided by the government-appointed storage provider, for the purpose specified by law. The government-appointed storage provider is the Hungarian Tourism Agency (MTÜ). The storage tasks introduced by this legislative amendment are carried out by the Guest Information Closed Database (VIZA) system. Under the applicable laws, every Hungarian citizen, regardless of age, is required to have an official identity document (identity card, passport, or card-format driving licence), including newborns. Under the legislation, recording data is equally mandatory for every guest, so recording cannot be omitted based on age or any other factor — e.g. the fee payable for the service, discounts, length of stay, or family relationship with the guest. The guest using the accommodation service presents their identification document to the accommodation service provider for the purpose of recording the data. In the absence of presenting the document, the accommodation service provider refuses to provide the accommodation service. By checking in at the hotel, the Guest accepts the Service Provider’s General Terms and Conditions, as well as the House Rules of the Service Provider’s departments. The guest is obliged to comply with the Service Provider’s House Rules during their stay at the hotel.
d. The Service Provider assumes no liability for injuries attributable to the Guest’s own fault.
e. The cost of damage caused by intentional vandalism is charged by the Service Provider to the Guest.
f. The entire area of the hotel is non-smoking. Pursuant to Act XLII of 1999 on the Protection of Non-Smokers, smoking is prohibited in the hotel’s enclosed areas (including guest rooms) and communal areas. The hotel’s employees are entitled to warn guests and any other person present on the hotel’s premises to comply with the law or to stop unlawful behaviour. Guests and any other person present on the hotel’s premises are obliged to comply with the law and any request made to them. If the hotel’s operator is fined by the competent authority based on the referenced legislation due to the unlawful conduct of any guest or other person present on the hotel’s premises, the operator reserves the right to pass on the amount of the fine to the person who engaged in the unlawful conduct, or to demand its payment from them. In the event of a breach of the smoking ban, the Service Provider charges a flat-rate compensation of HUF 15,000, which covers the cost of increased cleaning and ventilation. Smoking is only permitted in outdoor areas specifically designated by signage.
Refusal to Perform the Contract, Termination of the Service Obligation
a. The Service Provider is entitled to terminate the accommodation contract with immediate effect and to refuse to provide the services in the following cases:
i. The guest does not use the room or other premises of the hotel provided to them for their intended purpose;
ii. The Guest suffers from an officially confirmed infectious disease posing a public health risk;
iii. The Guest endangers the safety or order of the hotel, behaves objectionably or rudely towards employees or guests, is under the influence of alcohol or drugs, or exhibits threatening, offensive, or otherwise unacceptable behaviour;
iv. The Guest fails to fulfil their payment obligation specified in the Contract.
Accommodation Guarantee
a. If the Service Provider, due to its own fault, is unable to provide accommodation for the Guest, e.g. due to temporary operational problems, overbooking, etc., it is obliged to arrange accommodation for the Guest.
b. The Service Provider is obliged to offer the services specified in the contract, at the price specified in the contract, at another accommodation of the same category. All additional costs of providing the substitute accommodation are borne by the Service Provider.
c. The Service Provider provides free transfer for the Guest to move to the offered accommodation, and for any return transfer.
d. The Service Provider provides the Guest with a free phone call to communicate the change of accommodation.
e. If the Service Provider fully complies with these obligations, and the Guest has accepted the substitute accommodation offered, the Guest/Contracting Party may not make a subsequent claim for damages.
Illness or Death of the Guest
a. If the Guest becomes ill during their stay and is unable to act on their own behalf, the Service Provider offers medical assistance.
b. In the event of the Guest’s illness/death, the Service Provider is entitled to compensation from the sick/deceased guest’s relative, heir, or the payer of the invoice for any medical and procedural costs incurred, the value of services used before the death, and any damage caused to equipment or furnishings in connection with the illness/death.
Rights of the Contracting Party
a. The Guest is entitled to the intended use of the booked room, as well as those areas of the hotel that fall within the normal scope of use and are not subject to individual terms.
b. During their stay at the accommodation, the Guest may lodge a complaint regarding the performance of the services provided by the Service Provider. The Service Provider undertakes to handle any complaint submitted to it in writing, verifiably, during the Guest’s stay at the accommodation.
c. The Guest may lodge a complaint regarding the performance of the service during, or after, their stay, via the Service Provider’s official contact channels.
Obligations of the Contracting Party
a. The Contracting Party is obliged to settle the consideration for the services ordered in the Contract by the date and in the manner specified in the Contract.
b. The Guest is obliged to ensure that any child under 18 for whom they are responsible is present at the Service Provider’s hotel only under adult supervision.
c. The Guest may not bring their own food or drink into the hotel’s catering outlets.
Liability for Damages of the Contracting Party
a. The Guest is liable for all damages and disadvantages suffered by the Service Provider or a third party due to the fault of the Guest, their companion, or other persons for whom they are responsible. This liability also applies if the injured party seeks restitution directly from the Service Provider.
Rights of the Service Provider
a. If the Guest fails to fulfil their obligation to pay for services used, or for penalty-liable services ordered but not used, the Service Provider has a lien, to secure its claims, on the Guest’s personal belongings brought to the hotel.
Obligation of the Service Provider
a. The Service Provider is obliged to perform the accommodation and other services ordered under the contract in accordance with applicable regulations and service standards.
b. The Service Provider is obliged to investigate the Guest’s written complaint and take the necessary steps to address the issue, which it must record in writing.
Liability for Damages of the Service Provider
a. The Service Provider is liable for all damage suffered by the Guest within its premises due to the fault of the Service Provider or its employees.
b. The Service Provider’s liability does not extend to damage events caused by an unavoidable cause beyond the control of the Service Provider’s employees and guests, or damage caused by the Guest themselves.
c. The Service Provider may designate areas within the hotel that the Guest may not enter. The Service Provider assumes no liability for any damage or injury occurring in such areas.
d. The Guest must immediately report any damage suffered to the hotel and provide all necessary information required to clarify the circumstances of the damage event, and, if necessary, for a police report or police procedure.
e. The Service Provider is only liable for valuables, securities, or cash if it has expressly accepted them for safekeeping.
f. The Service Provider is liable for items brought in by the Guest in accordance with the provisions of the Civil Code.
g. The Service Provider investigates any damage occurring to a vehicle in its car park, and if the damage was caused by negligence attributable to it, it compensates for it.
h. The Service Provider assumes no liability for valuables left in a vehicle in its car park.
i. The upper limit of compensation is fifty times the daily room rate under the contract. This limitation of liability does not apply to damage caused intentionally or through gross negligence, nor to damage affecting life, physical integrity, or health.
Confidentiality
a. In fulfilling its contractual obligations, the Service Provider is obliged to act in accordance with Act CXII of 2011 on the Right of Informational Self-Determination and Freedom of Information, as well as Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR).
Complaint Handling
a. Pursuant to Section 17/A of Act CLV of 1997 on Consumer Protection, the Service Provider informs the Guest that complaints are handled at the Service Provider’s registered office (2144 Kerepes, Szabadság út 102., Hungary). Complaints may also be submitted by email to info@visvitalishotel.eu.
b. Under the Consumer Protection Act, the Guest may initiate proceedings before the conciliation board with jurisdiction over their place of residence/stay if they have attempted to resolve their complaint with the Service Provider in writing but without success.

c) Online Dispute Resolution Platform
The European Commission’s Online Dispute Resolution (ODR) platform is available at the following link: https://ec.europa.eu/odr The platform enables consumers to settle disputes arising from contracts concluded online, out of court.
Force Majeure
Force majeure means any circumstance beyond the Parties’ control, which is unforeseeable and unavoidable, and which makes performance of the contract wholly or partly impossible or hinders it (e.g. war, natural disaster, flood, fire, official restrictions due to epidemic, general power outage, strike).
For the duration of a force majeure event, the affected Party is released from performing its contractual obligations, provided it proves that the circumstance meets the above conditions.
The affected Party is obliged to notify the other Party without delay of the force majeure event.
The Parties are obliged to take all measures reasonably expected of them to mitigate the damage and restore performance as soon as possible.
Governing Law and Competent Court
a. The legal relationship between the Service Provider and the Contracting Party is governed by Hungarian law. Any legal dispute arising from the service contract falls under the jurisdiction of the court competent for the place where the service is provided.
